User Agreement
Welcome to the ArtAroundLife Marketplace (hereinafter referred to as the “Marketplace”). These Terms of Use (hereinafter referred to as the “User Agreement”) govern the relationship between you as a Marketplace user (referred to herein, as the context requires, as “User,” “you,” or “your”) and ArtAroundLife LLC (referred to herein, as the context requires, as “ArtAroundLife,” the “Marketplace,” “we,” or “our”). Marketplace users include all independent third-party sellers (hereinafter referred to as “Sellers”) as well as their respective customers and potential customers (hereinafter referred to as “Buyers”).
If you are a Seller, you acknowledge and agree that you bear significant legal responsibility for uploading, publishing, posting, or otherwise generating any graphics, images, artwork, creative works, photos, illustrations, listings, information, text, data, videos, sounds, music, or any other material on the Marketplace (collectively, “Content”). You are responsible for ensuring that your use of the Marketplace does not infringe on anyone’s rights or violate any laws, including by posting your Content, offering products for sale that display your Content (the “Products”), and otherwise using or accessing the hosting and facilitation services provided by ArtAroundLife in the Marketplace (the “ArtAroundLife Services”). The ArtAroundLife Services include, but are not limited to, facilitating customer service interactions between Sellers and Buyers, processing payments via third parties, marketing and promotional activities for Sellers within and outside of the Marketplace, and third-party distribution and manufacturing of Sellers’ Products. If a Buyer decides to order a Seller’s Product, the Marketplace will forward the order information to independent third-party fulfillment providers (the “Fulfillers”) in accordance with the Seller’s and Buyer’s instructions, and the Fulfillers will manufacture and ship the Products in the manner specified by the Seller and Buyer.
All users should be aware that ArtAroundLife does not pre-screen all Content or Products uploaded or otherwise generated by Sellers on the Marketplace. While ArtAroundLife does not permit illegal Content or Products on the Marketplace, it cannot guarantee that every Seller will always comply with this User Agreement or the law.
Sellers are responsible for the applicable rights to their Content and Products and are in the best position to respond to inquiries about their Content and Products. Additionally, if you are simply browsing other users’ artworks and Products, please respect others’ intellectual property rights and do not steal their or anyone else’s art. All users should respect each other and the artworks they discover here. By doing so, you will help make this community a creative, inspiring, and enjoyable place.
You agree that whenever you use the Marketplace, register an account, log in, or place an order on the Marketplace, you are bound by the terms of this User Agreement. Therefore, it is essential that you read and agree to all the terms of this User Agreement. If you do not agree with the terms of this User Agreement or any of our other policies — including, but not limited to, our Intellectual Property/Publicity Rights Policy, our Community and Content Guidelines, and our Privacy Policy (all of which are incorporated herein by reference) — then you may not use the Marketplace or any ArtAroundLife Services.
In particular, please carefully read Section seven below, which contains binding arbitration provisions and a class action waiver that affect how disputes between you and ArtAroundLife are resolved.
This User Agreement is divided into the following sections:
I.General Terms for All Users
II.Special Terms for Buyers
III.Special Terms for Sellers
IV.Dispute Resolution, Binding Individual Arbitration, Jury Trial Waiver, and Class Action Waiver
V.Community and Content Guidelines
VI.Intellectual Property and Publicity Rights

You bear full responsibility for any losses arising from use of your password by you or anyone else.
You agree not to disclose your password to anyone else or store it in a location accessible to anyone other than yourself. If you suspect that someone else knows your password, you must change it immediately.
If you lose access to your account and ask for our assistance to recover it, we may, to the extent permitted by law, require you to provide identity verification to ensure that you are the account owner. This helps ensure account security and prevents unauthorized third-party access.
Intellectual Property Infringement Claims

For more information on intellectual property matters, please see our Intellectual Property/Publicity Rights Policy.
Reporting Inappropriate Content
Because publishing is fully automated, ArtAroundLife does not pre-screen any Content or Products posted by Sellers on the Marketplace. Responsibility for the Content and Products lies entirely with the respective Seller, and ArtAroundLife cannot guarantee that Sellers will not display “Inappropriate Content.” Inappropriate Content includes, but is not limited to, content that infringes any individual’s or company’s copyright, trademark, or other intellectual property rights; or content that is defamatory or disparaging to any individual, ethnic group, race, religion, or religious group; obscene, pornographic, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inciting, offensive, or otherwise illegal or in violation of this User Agreement, our Intellectual Property/Publicity Rights Policy, or our Community and Content Guidelines. ArtAroundLife reserves the right to remove or restrict access to any user Content or Products at its sole discretion.
If you find Inappropriate Content on the Marketplace, please notify us immediately to help us address the issue. You can do so by clicking the “Inappropriate Content” link displayed on each product listing page. If you believe your intellectual property (including copyright and trademark) or other rights are being infringed, you can submit a notice and takedown request. For more information on intellectual property matters, please see our Intellectual Property/Publicity Rights Policy.
Intellectual Property and License
By uploading your Content to the Marketplace, you grant ArtAroundLife and its affiliates, successors, and assigns a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to distribute, host, transmit, store, use, copy, and publicly display your Content as posted on the Marketplace in any media format and through any media channels in connection with the business of ArtAroundLife or its affiliates, including for marketing the Marketplace, redistributing the Marketplace in whole or in part, and providing the ArtAroundLife Services. This includes facilitating activities and functionality required or expected by this User Agreement or related to third-party activities such as manufacturing, promotion, marketing, advertising, and distribution of your Products and making them available for viewing and access by users. This license terminates within a commercially reasonable time after you remove or delete your Content from the Marketplace. Any comments you publicly post on the Marketplace are subject to a perpetual, irrevocable license.
Unless otherwise stated in this User Agreement or in a separate agreement under Section III: Seller Special Terms: Partner Program, you retain any intellectual property rights you hold in your Content.
All intellectual property, ownership, and rights in the Marketplace (including the underlying software and systems, the ArtAroundLife mobile app, and any text, graphics, logos, icons, recordings, and software) belong to or are licensed by ArtAroundLife. These include any and all rights under patent, copyright, trade secret, trademark, unfair competition law, and any other proprietary rights, including applications, renewals, extensions, and restorations. Except as expressly authorized in this User Agreement or as permitted under applicable intellectual property law, you may not use, adapt, copy, store, distribute, print, display, perform, publish, or create derivative works from any part of the Marketplace, nor may you commercialize any information or services from the Marketplace without ArtAroundLife’s prior written permission. You may not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble, or otherwise attempt to obtain source code from the website or mobile application, nor may you remove, obscure, or alter any ArtAroundLife copyright notices, trademarks, or other ownership statements, regardless of whether they are affixed to, contained in, or accessed through the website or app.
If you use our trademarks or other intellectual property in connection with our activities, products, or services, you must include a statement indicating that the trademark belongs to us. You may not use our trademarks in whole or in part as your trademark; use them for activities, products, or services not belonging to us; use them in a manner likely to cause confusion, mistake, or deception; or use them in a disparaging way about us or our information, products, or services.
Linked Websites
The Marketplace may contain links to other websites owned or operated by third parties (“Linked Websites”). These links are provided solely for your convenience and may not be current or maintained. We are not responsible for the content or privacy practices of Linked Websites. Any link to a Linked Website should not be interpreted as our endorsement, approval, or recommendation of the owner or operator of that website or any information, graphics, materials, products, or services referenced or included on it, unless stated otherwise.
Privacy Policy
We take your privacy seriously. Users should refer to our Privacy Policy, which is incorporated by reference into this User Agreement, to understand how we collect and use personal information. When you use the Marketplace and the ArtAroundLife Services, you may grant us certain permissions for your device. Most devices (e.g., mobile devices) will provide information about these permissions. Please review our Privacy Policy for more information about these permissions.
Although we take reasonable measures to protect users, you must also take precautions to ensure that your access to our Marketplace and use of the ArtAroundLife Services does not expose you to viruses, malware, or other risks that may damage your computer systems.
You acknowledge that our ability to verify other users’ identities may be limited. Despite our reasonable security measures, accounts may contain inaccurate or outdated contact information and/or be used in ways that infringe the rights of others.

Special Terms for Buyers
The terms in this section do not limit the other parts of this User Agreement that apply to Buyers (as well as to Sellers and all Marketplace users).
Purchasing Products on the Marketplace
Buyers can purchase goods from Sellers on the Marketplace using a valid credit card or third-party payment platform. You do not need to be a registered user to make a purchase. The retail price you pay is determined by the Seller and is fixed at the time you place your order. We may charge an additional service fee at checkout to cover the platform’s operating costs, which facilitate connections between Sellers, Buyers, and fulfillment providers.
Once a Buyer submits an order, it cannot be canceled. As a customer of the Seller, you are responsible for ensuring that your shipping address is accurate. ArtAroundLife, the Seller, and any other third party shall not be liable for any failure to receive or any delays in receiving a Product due to issues related to the shipping address you provided to the platform, including but not limited to errors in the address you provided.
We do not guarantee, endorse, represent, or recommend any Content, artwork, images, or text hosted on the Marketplace, or any Products sold by Sellers on the Marketplace. Sellers’ Content may imitate, reference, or otherwise be inspired by well-known brands or public figures, but it is not approved or endorsed by any brand or individual. ArtAroundLife makes no representations or warranties about any such approval, affiliation, or authorization. Sellers are responsible for their uploaded Content and Products, including ensuring they have obtained any necessary third-party rights or licenses.
Shipping
Products will be shipped according to your instructions via mail or courier, and you are responsible for paying the amount specified at the time of purchase. Shipping costs will be included in the order total and will vary depending on factors such as location, product size, and price.
Damaged Products and Returns
If you receive a damaged Product, we will notify the relevant third party involved in fulfilling the order to arrange for a replacement Product to be sent to you. As a condition for compensation for the damaged Product, you may need to provide reasonable proof of damage, such as a photograph of the damaged Product or returning the damaged Product to the Marketplace. You will be responsible for any costs incurred in returning such Products. If you receive a damaged Product, you must contact our customer service by email within fourteen (14) days of receipt to report the nature of the damage and request a new Product at no cost to you. In addition to the above policy for damaged Products, Buyers seeking to return Products for other reasons may find alternative solutions in our Help Center.
Please note that there are two types of Content on the Marketplace:
(1),Seller Self-Managed Products (Category: My Personal Items) – These are created and controlled by the Seller, including the design of the Products and any product previews. ArtAroundLife only provides technical support and payment processing for these items, and the Seller bears full legal responsibility for the Products. As a customer, you are responsible for verifying whether the Product is what you want to purchase before ordering from the Seller’s store. This includes, but is not limited to, verifying the quality of the Content, the images printed on the Product, spelling errors, grammar errors, formatting, overall design and appearance, licensing status, source or country of origin of the Product, affiliations, or overall appearance. If you need more information to verify that the Product is what you want, you may contact the Seller directly using the Ask a Question feature on the Seller’s store page or by other methods the Seller provides (such as their social media pages).
(2),Products Managed by ArtAroundLife on Behalf of the Seller (All Other Categories) – These Products are created using Content provided by the Seller, and the Seller has authorized ArtAroundLife to generate and sell these Products (including, but not limited to, design, development, production, display, sale, and shipment of the Products). As a customer, you are responsible for verifying whether the Product is what you want to purchase before ordering from the relevant Seller’s store. This includes, but is not limited to, verifying the quality of the Content, the images printed on the Product, spelling errors, grammar errors, formatting, overall design and appearance, licensing status, source or country of origin of the Product, affiliations, or overall appearance. If you need more information to verify that the Product is what you want, you may contact the Seller directly using the Email link on the Seller’s store page or by other methods the Seller provides (such as their social media pages).

III.Special Terms for Sellers
The terms in this section do not limit other parts of this User Agreement that apply to Sellers (as well as to Buyers and all Marketplace users).
As a Seller, you wish to use the ArtAroundLife Services to facilitate the marketing and sale of your Products, and to coordinate with third-party fulfillment providers for the production of your physical Products, as well as for the subsequent delivery of your Products to your customers. ArtAroundLife will provide its Services in accordance with the terms of this User Agreement.
Most importantly, to ensure that this creative online platform remains accessible to everyone, all users must respect the intellectual property rights of others, including copyrights, trademark rights, and rights of publicity. Sellers may only upload their own original works and may only sell Products that feature their original works. If you upload or use Content that was not created by you, you must have obtained permission from the relevant rights holder for that Content. Respect for everyone’s intellectual property and other rights is a fundamental principle of this platform.
Additionally, by showcasing your artwork on the Marketplace, it can be viewed by people around the world. You must be aware that publishing your Content in this manner carries significant legal responsibilities. You are responsible for ensuring that your use of the Marketplace (including publishing your Content, offering your Products for sale, and otherwise using or accessing the ArtAroundLife Services) does not infringe upon the rights of others or violate any laws.
Please note that there are two types of Content on the Marketplace:
(1)Seller Self-Managed Products (Category: My Personal Items) – These are created and controlled by you, including the design of the Products and any product previews. ArtAroundLife only provides technical support and payment processing (charging a 5% fee), and you bear full legal responsibility for the Products. Therefore, the Content and Products are entirely your responsibility. As a Seller, before shipping the Product to the relevant Buyer, you are responsible for verifying that the Product is what the Buyer wants, including but not limited to the quality of the Content, the images printed on the Product, spelling errors, grammar errors, formatting, overall design and appearance, licensing status, source or country of origin of the Product, affiliations, or overall appearance.
(2),Products Managed by ArtAroundLife on Behalf of the Seller (All Other Categories) – These Products are created using Content you provide and are authorized by you for ArtAroundLife to manage on your behalf, including but not limited to design, development, production, display, sale, and shipment of the Products. For these Products, ArtAroundLife is responsible for all aspects of design, production, and shipping (which may involve third-party partners) and charges an 80% fee.
ArtAroundLife Services
ArtAroundLife will act as an independent contractor to provide these Services in accordance with your instructions. ArtAroundLife will assist you in marketing your Products to Buyers through the Marketplace and in obtaining Buyer orders. Based on your instructions, ArtAroundLife will coordinate with third parties for payment processing and production of your Products to fulfill those orders, and will coordinate with third parties to deliver your Products in accordance with the Buyer’s instructions. While ArtAroundLife acts as an independent contractor in providing the ArtAroundLife Services, you remain the principal in the sales transactions between you and your Product Buyers.
ArtAroundLife will continue to provide the ArtAroundLife Services until this User Agreement is terminated in accordance with its terms.
You agree that ArtAroundLife may act in any capacity for any other person seeking to promote, market, and obtain orders from the public for purchasing Products on the Marketplace, including Products that are the same as or similar to yours.
License and Ongoing Instructions
Without limiting any other rights and licenses you grant to ArtAroundLife, its affiliates, or third parties in connection with the ArtAroundLife Services—including those in Section I: General Terms for All Users and any applicable licensor terms and conditions—you hereby grant ArtAroundLife the rights and licenses set forth in this User Agreement to enable us to perform the ArtAroundLife Services. You specifically instruct ArtAroundLife to facilitate the sale of your Products, including facilitating payment processing and arranging for your Products to be manufactured to fulfill orders placed by Buyers through the Marketplace, and ArtAroundLife will promote such payment and manufacturing in accordance with reasonable commercial practices unless you provide other instructions before the Buyer places the order.
Selling Your Products
The retail price charged to Buyers for your Products includes the manufacturing fees charged by third-party manufacturers, the fees for ArtAroundLife to host the Marketplace and facilitate transactions (together, these are the “Base Amount,” inclusive of taxes), your Creator Profit (“Your Profit”), and any applicable sales tax that ArtAroundLife and/or you (as applicable) are obligated to remit to the relevant tax authorities (such as sales tax, GST, VAT, etc.). The total amount may be adjusted for any Marketplace discounts and shipping fees added to the retail price. When selling each Product, you may choose any markup percentage above zero, provided it is above the Base Amount and below the automatic cap (which may change from time to time). The markup percentage you select in the Marketplace for each Product determines the monetary value of Your Profit for each sale.
You may change the markup percentage based on the Base Amount at any time by adjusting your choices in the Marketplace. The Base Amount may be updated at any time without notice, which may affect the margin (as a percentage of the Base Amount) you have set. Once a Buyer submits an order on the Marketplace, the retail price for that single sale will remain fixed.
When your Product receives an order, you will receive an automatically generated email at the email address you have registered to your account.
You acknowledge and agree that ArtAroundLife does not guarantee the placement of any order for your Products (whether at the retail price or otherwise) and does not guarantee that you will obtain any benefit as a result of entering into this User Agreement.
All goods purchased from the Marketplace are produced by third-party fulfillment providers according to your design instructions and pursuant to agreements between you and those third-party fulfillment providers. This means that ownership and risk of loss for such goods pass directly from you to the Buyer without ArtAroundLife’s involvement, once the goods are delivered to the Buyer as instructed.
Payment Terms
You authorize ArtAroundLife to collect, hold, and distribute the retail price paid by Buyers (the “Sales Proceeds”) in accordance with this Payment Terms section. In addition, Buyers are responsible for paying any shipping costs for the Products, but this does not affect the amount you are entitled to receive.
You authorize ArtAroundLife to deduct the Base Amount (which includes ArtAroundLife’s convenience service fee, as applicable, inclusive of taxes) from your Product Sales Proceeds before distributing your margin (including any applicable taxes).
We will pay your margin using the payment method you selected in your Marketplace account, typically between the 15th and 20th of each month.
We may establish payment thresholds for a given month or other period; if the payment amount does not exceed the applicable threshold for that period, your payment may be delayed until it exceeds the threshold.
It is your responsibility to ensure that ArtAroundLife has your current postal address, bank account information, and any other information we require under our policies and/or applicable law. If the payment method or information you provide is incorrect, ArtAroundLife is not responsible for any resulting losses. If you cannot receive your payment due to inaccurate or outdated information, your margin may be delayed or withheld. If you fail to notify ArtAroundLife of any changes to your payment method within the specified time, your margin may be forfeited to ArtAroundLife or donated to a designated charity, as permitted by applicable law.
To help us verify your identity, protect your account security, and comply with applicable law, we may ask you to provide your most current and accurate information (such as your name, physical address, phone number, date of birth, tax ID or VAT number, and company registration details, if applicable). We may also ask you to send additional documents or information to help verify your identity, such as a copy of a government-issued ID and any other documents that the law may require. Using false information or impersonating another person through your account is prohibited. You agree and acknowledge that if you fail to provide the requested information or documents, your account may be suspended or terminated, and any Seller earnings associated with your account may be delayed or withheld.
Any information you choose to make publicly available in your profile may be viewed, distributed, or linked within the Marketplace and on third-party platforms (for example, if you choose to promote your Products on external marketing platforms).
Account Levels
Your account may be classified as an ArtAroundLife Standard Account, ArtAroundLife Premium Account, or ArtAroundLife Professional Account. The classification is based on various criteria and may be adjusted at our discretion. Additional fees may apply to one or all account levels. Account fees are charged when Sellers make sales within a given payment period, and they are fixed based on income for that period. If you make no sales within a payment period, no fees are due. If fees do apply, they will be automatically deducted from your payments.
Tax Responsibilities
In accordance with applicable federal or state tax laws or regulations, ArtAroundLife may collect and remit sales taxes (such as sales tax, GST, VAT, etc.) on your behalf. However, if federal or state law does not require ArtAroundLife to collect and remit sales taxes:
(a) Each party is responsible for any taxes related to their own transactions and for accounting for any taxes imposed by government or regulatory authorities, as well as any accounting or audit requirements arising from, caused by, incidental to, or related to obligations under this User Agreement. We recommend consulting your tax advisor about your tax obligations as a Seller. These may include sales tax, VAT, GST, other transaction taxes, and income taxes;
(b) Because you are the principal in selling Products to Buyers, ArtAroundLife will not collect or remit taxes on your behalf. As stated in “Payment Terms” above, any amounts allocated to you will be treated as inclusive of any applicable taxes. You remain solely responsible for reporting and remitting any tax liabilities arising from the sale of your Products, as well as any interest or penalties that may be assessed by tax authorities for non-compliance; and
(c) You are solely responsible for reporting all tax-related liabilities to the relevant tax authorities.
Seller Representations and Warranties
By uploading your Content to the Marketplace, you represent and warrant that:
- You own all applicable rights in the Content, including but not limited to intellectual property and publicity rights; or, if you are not the owner, you have obtained permission from the owner to display, reproduce, distribute, create, sell, and otherwise use the Content and Products on the Marketplace;
- The Content and Products do not infringe on any third party’s intellectual property or other rights, including copyrights, moral rights, trademarks, patents, privacy, or publicity rights;
- Your use of the Marketplace and the Content will comply with our Intellectual Property / Publicity Rights Policy;
- Your use of the Marketplace will comply with all applicable laws;
- Your use of the Marketplace and the Content will comply with our Aboriginal and Torres Strait Islander Art Policy (if applicable);
- All Content has accurate titles, tags, and descriptions;
- The Content does not contain defamatory or slanderous material about any individual, ethnic group, racial group, religion, or religious group, and does not include obscene, pornographic, lewd, harassing, threatening, harmful, privacy-violating, or other objectionable material;
- Your use of the Marketplace and the Content will comply with our Community and Content Guidelines;
- The Content does not include malicious code, including viruses, Trojan horses, worms, time bombs, cancelbots, or any other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, data, or personal information; and
- The Content is not misleading or deceptive, does not offer or promote fraudulent goods, services, schemes, or promotions, and does not market Products for uses or to consumers for whom they are not intended.
If we believe that you or your Content violates or may violate this User Agreement, any agreement with a third party, any law, our Intellectual Property / Publicity Rights Policy, our Community and Content Guidelines, or any of our other policies, or for any other reason, ArtAroundLife reserves the right to review, disable, or terminate your account, and to remove, disable, or limit access to any of your Content or Products in the Marketplace.
You acknowledge and agree that you are responsible for any direct or indirect damages caused to ArtAroundLife or any third party as a result of your violation or alleged violation of this User Agreement or any of your representations or warranties, and you agree to indemnify ArtAroundLife as set out in the “Indemnification” section below.
Partner Program
Additional terms and conditions apply to any Content you submit to the ArtAroundLife Partner Program (“Partner Program”) or otherwise incorporate into it. Each licensor in the Partner Program (“Licensor”) may impose specific terms and conditions on your use of their intellectual property that differ from or exceed the terms of this User Agreement and may continue to apply even after this User Agreement ends (“Licensor Terms and Conditions”). By submitting or otherwise incorporating your Content into the Partner Program, you agree to the applicable Licensor Terms and Conditions, which may require you to transfer any ownership interests you have in the Content to the Licensor, obtain pre-sale approvals, restrict your use of the Content inside and outside of the Marketplace, require adherence to style guides, and/or limit any legal or equitable remedies you, licensees, successors, assigns, Licensors, or third parties may have in connection with the use of the Content.
Additionally, when a Licensor terminates or modifies its participation in the Partner Program, it may result in changes to or removal of any Content authorized by the Licensor (including Content you had licensed, approved, or authorized during the partnership period). Licensors may also unilaterally approve, reject, modify, or delete any Content within their rights at any time. You agree that ArtAroundLife, Licensors, and other third parties are not liable for any losses you incur as a result of such modifications or removals.
Before including your Content in the Partner Program, carefully review the applicable Licensor Terms and Conditions to ensure you understand and accept the limitations on your rights. Licensor Terms and Conditions are available on our current brand partners page. All Licensor Terms and Conditions are hereby incorporated by reference into this User Agreement and survive its termination.
Handling of Returned Products with Your Content
All Sellers authorize ArtAroundLife to facilitate the sustainable disposal of any returned Products, including but not limited to refunds, reprints, or product sampling.
Seller Promotion and Marketing Services
ArtAroundLife facilitates your promotion and marketing of Products featuring your Content by providing ArtAroundLife Services, including tools for Sellers to create publicly viewable Product listings and make Products available to Buyers. Buyers can find your Products through Marketplace-wide search tools and/or third-party online and social media channels. If you choose to have your Products included in offsite marketing, ArtAroundLife has no obligation to facilitate those marketing activities and you acknowledge that such activities are outside of ArtAroundLife’s control, depending on the actions of third parties, such as third-party marketing platforms and their users. You or ArtAroundLife may at any time decide to exclude your Products from offsite marketing for any reason.
Indemnification
You agree to indemnify, defend, and hold harmless ArtAroundLife, our officers, directors, employees, affiliates, agents, and representatives, and all third parties involved in the Marketplace (including but not limited to fulfillment partners, third-party shippers, payment processors, and Licensors who facilitate your Product sales or provide them for sale), as well as their respective officers, directors, employees, affiliates, agents, and representatives, from and against any and all claims, damages, losses, liabilities, costs (including reasonable legal fees), or other expenses arising directly or indirectly from:
- Your breach or alleged breach of any term of this User Agreement;
- Any claim that your use of the Marketplace, your Content, or your Products infringes or misappropriates any third-party copyright, trademark, trade secret, intellectual property, or other rights; and/or
- Your activities in connection with the Marketplace.
As permitted by applicable law, you acknowledge and agree that ArtAroundLife may freeze or hold all or part of the funds in your account to fulfill your indemnification obligations, including payment of any past or future legal fees reasonably incurred by ArtAroundLife or indemnified parties, or as required by legal process or law.
This indemnification obligation applies regardless of any negligence by either party (including any indemnified person). Except for any other terms that explicitly survive termination in this User Agreement, this indemnification obligation survives the termination of this User Agreement.
Limitation of Liability
In addition to the other disclaimers and limitations of liability in this User Agreement, ArtAroundLife will not be liable for any indirect losses or damages you may suffer arising out of this User Agreement. To the extent permitted by law, all implied warranties and conditions are expressly excluded.
Termination of Your Seller Account
You may close your account by following the procedure described in Section I: Termination and Account Restrictions to provide notice of termination of this User Agreement. ArtAroundLife may terminate this User Agreement at any time by closing your account or providing written notice to you.
Upon notice of termination, you authorize us to complete any transactions related to your Products in accordance with the terms of this User Agreement. Termination of this User Agreement will take effect once these transactions are complete.
Upon termination of this User Agreement by either party, we will pay any accrued margin earnings from your account, less any applicable administrative fees, as described in Section III: Indemnification and Applicable Law.
- Dispute Resolution, Binding Individual Arbitration, Jury Trial Waiver, and Class Action Waiver
Please read this section carefully. This provision applies to all Users regardless of where you reside in the world. However, if you live outside of the United States, you may be entitled to mandatory consumer protection provisions under your local law. By accepting these terms, you and ArtAroundLife (or its affiliates) expressly waive the right to a jury trial and to participate in any class action (the “Arbitration Agreement”).
If you encounter any problems or disputes, we will make every effort to resolve them. All legal disputes will be governed by the courts of the State of New York, without regard to its or any other jurisdiction’s choice of law provisions.
- Claims Covered by the Arbitration Agreement
The arbitration agreement between you and ArtAroundLife is very broad. It covers all disputes, claims, or controversies, including those that may have arisen before you agreed to these terms (the “Terms”), and that arise out of or relate to (i) these Terms; (ii) any part of the ArtAroundLife Services, including but not limited to the purchase or sale of Products through the Marketplace; (iii) any transactions with ArtAroundLife, including any of its affiliates, agents, contractors, employees, or representatives; and (iv) your relationship with ArtAroundLife, including the validity, enforceability, and scope of this Arbitration Agreement (collectively, the “Disputes”).
Except for the Disputes described in the next sentence, you agree that all Disputes shall be resolved through binding arbitration, subject to the limitations described in Sections C and D below. Disputes that may be brought in small claims court are not subject to arbitration.
- Agreement to Attempt Informal Resolution of Disputes
It is in everyone’s best interest to resolve problems as quickly and efficiently as possible. Therefore, the parties agree to attempt to resolve any Dispute informally for at least 45 days before initiating arbitration. The 45-day period begins when one party receives written notice from the other party (the “Dispute Notice”). The Dispute Notice must: (a) include the full name and contact information of the party raising the Dispute; (b) describe the nature and basis of the Dispute; and (c) explain the relief sought. We will send any Dispute Notice to your billing or email address, or both. You must send your Dispute Notice to:
Recipient: ArtAroundLife LLC, 418 Broadway Ste N, Albany, NY, 12207.
Any proposals made during the 45-day informal resolution period will remain confidential and cannot be disclosed to the arbitrator in any subsequent arbitration proceeding.
Both parties explicitly agree that if either party initiates arbitration without first attempting to resolve the Dispute informally as provided in this section, the arbitration proceeding may be administratively terminated at the request of either party.
- Binding Arbitration Rules
If we are unable to resolve the Dispute informally, either party may choose to finally and fully resolve the Dispute through confidential, binding arbitration. Any decision to arbitrate shall be final and binding on the other party.
You and we agree that this User Agreement evidences a transaction involving interstate commerce and that this Arbitration Agreement will be interpreted and enforced according to the U.S. Federal Arbitration Act and federal arbitration law, not state law. The arbitration will be conducted in English. Subject to the express limitations on arbitration in Section D below, the arbitrator may award any relief that would be available in court, except that this Arbitration Agreement expressly excludes any injunctive, equitable, or declaratory relief. Any request for injunctive relief (if such relief is allowed) must be sought separately through a court. If you seek both monetary and injunctive relief, you agree that, under Section 3 of the Federal Arbitration Act, the court may stay your injunctive relief request until the Dispute is resolved through arbitration.
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (the “AAA Consumer Rules”), with the following modifications:
- Arbitration fees and costs shall be governed by the AAA Consumer Rules. If the arbitrator finds such fees excessive, or if you send documentation to the address listed above showing that you cannot afford to pay the administrative fees required to initiate arbitration, we will pay all AAA administrative fees.
- If the total amount in dispute is $25,000 or less, the arbitration will be conducted solely on the basis of written submissions, unless the arbitrator decides to hold a hearing at the request of either party.
- Either party may file dispositive motions during the arbitration.
- The arbitrator shall issue a written decision that includes the essential findings and conclusions.
- The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. A party may file a court action to compel arbitration, stay the arbitration proceeding, or confirm, modify, vacate, or enter judgment on the arbitrator’s award. To that end, you and ArtAroundLife agree to the exclusive jurisdiction of the federal and state courts in San Francisco County, California.
- AAA rules and forms are available at https://www.adr.org or by calling 1-800-778-7879.
- Class Action Waiver and Express Limitations on Arbitration
Both parties agree that any claims must be brought in their individual capacity only and not as a plaintiff or class member in any purported class or representative proceeding. If the above provision is found unenforceable, the entire Arbitration Agreement shall be void.
Despite the foregoing class action waiver, if the binding arbitration involving both parties is deemed to meet the AAA Consumer Rules’ criteria for “multiple consumer case filings,” either party may (but is not obligated to) request the arbitrator to consolidate all “multiple consumer case filings” before the same arbitrator. Only if such consolidation occurs, any party to the consolidated filings may apply in writing to the arbitrator for pre-hearing activities (such as discovery and dispositive motions) that would have common effect for all consolidated cases. Before deciding whether and to what extent to allow common pre-hearing activities, the arbitrator must give all affected parties an opportunity to be heard. For the avoidance of doubt, all arbitration hearings will remain conducted on an individual basis.
- Location of Arbitration Hearings
If an in-person arbitration hearing is required, it will be held in the county of your residence. - Severability
If any provision of this Arbitration Agreement (except the class action waiver in Section D) is found to be unenforceable, that provision will be severed, and the rest of this Arbitration Agreement will remain fully valid and enforceable.

- Community and Content Guidelines
Last updated: June 15, 2025
ArtAroundLife is a community of respect, support, and encouragement, passionate about art and creativity. We welcome artists of all skill levels and backgrounds. We kindly ask you not to seek out or engage with content you don’t resonate with—there’s no need for troublemaking. If you come across behavior or content that violates these guidelines, please report it using the report feature on our website. Most importantly, we encourage you to make the most of your time here by supporting artists. By contributing positively to the community, you’ll find that ArtAroundLife is a fun and rewarding place to be.
Detailed Guidelines
The following paragraphs outline how ArtAroundLife manages behavior and content. In the spirit of open communication, these guidelines are public, but note they are adaptive and will evolve over time. Depending on the severity, violations of these guidelines may result in a formal warning, account suspension, or termination. ArtAroundLife has internal policies and processes to ensure these guidelines are enforced consistently and fairly. ArtAroundLife reserves the right to remove work or close accounts at its sole discretion when enforcing these guidelines.
Age
Members must be at least 18 years old. This is a legal requirement, as individuals under 18 cannot enter into a valid contract with ArtAroundLife.
Adult Content
ArtAroundLife does not permit any adult content!
Adult Language
Malicious or harmful insults directed at other members (considered personal attacks) are prohibited.
Nudity and Pornography
ArtAroundLife does not allow nudity or pornography, including but not limited to:
- Sexual content: explicit and unwarranted foreplay; sexual acts including direct genital contact between any parties; male or female masturbation involving hand or artificial contact with genitals; ejaculation or vaginal secretions; urination in a sexual context; use of sex toys, including but not limited to penis rings, dildos, strap-ons, and vibrators in explicit sexual contexts; manual spreading of vaginal or anal openings (regardless of gender).
- Genitals: any unnecessary or unjustified images of genitals, typically including close-ups or images that focus on the penis, visible erection, or detailed exposure of the vaginal area.
- Nude or “sexy” children: ArtAroundLife takes a strict stance on images of children. Children should be appropriately clothed—no exposed genitals, buttocks, or (for pubescent girls) chest. Children are defined as anyone under 18. For babies or toddlers, some nudity (like in an Anne Geddes-style portrait) is acceptable, but genitals must be covered.
- General sexual provocation: images created primarily to arouse viewers without artistic intent.
References to Children or Children’s Clothing Designs
ArtAroundLife takes a conservative approach to references to children and designs for children’s clothing. Avoid any negative or inappropriate undertones (such as sexual or violent suggestions) or adult-themed slogans. Humor in children’s designs should be tested thoroughly, as it may inadvertently offend.
Self-Promotion
Sellers may promote their own work in the dedicated “My Personal Items” section but should avoid unsolicited self-promotion elsewhere, such as in comment sections on other members’ work. When promoting products and services in “My Personal Items,” sellers must be transparent, especially about financial details.
Violence and Hate
Works that glorify or trivialize violence or human suffering are prohibited. This includes graphic depictions of violence, works that downplay violence, or works and actions that incite hatred or violence. Content related to genocides, mass killings, or other catastrophic events should be handled with care. Works that could cause significant pain to victims may be removed.
Racism
Content, behavior, and materials that incite racism are prohibited. Racism is defined as:
- Hatred or intolerance toward other races.
- Hostility or discrimination based on a belief in one’s racial superiority.
- Prejudices that generalize an entire racial group’s characteristics (especially those that label them as inferior).
Use of racial slurs: Casual or derogatory use of racial slurs is prohibited. Works that use these terms in a reasonable context (like personal reflections on racism) may be allowed, but a T-shirt with a racial slur would not.
Symbol Usage
Symbols and icons (like Nazi symbols, crosses, Confederate flags, Hitler, or the Quran) convey strong messages and must be used with care. Content that appears intentionally provocative, violates anti-defamation or anti-racism guidelines, or is illegal in specific countries may be removed.
Specific Country Laws
Some countries regulate or ban certain symbols, images, or text. To comply with local laws, ArtAroundLife may remove words containing such content.
Defamation
Any work or behavior that can reasonably be considered defamatory is not allowed. However, works expressing views or critiques on matters of public interest generally do not fall under this definition.
Vilification
Defined as content or behavior that incites serious contempt, hatred, or severe ridicule of individuals or groups based on race, religion, disability, gender identity, sexual orientation, or other perceived vulnerabilities.
Harmful Misinformation
No harmful false information. Defined as any misleading or false information that threatens public health or safety, or aims to provoke fear or suspicion about real-world harm.
Unsolicited Criticism
Critiques should be given only when explicitly requested (e.g., “Critiques welcome” in a work’s description). Criticism includes negative assessments of quality or challenges to the work’s ideas or viewpoints. Unsolicited criticism can be disheartening and counterproductive.
Personal Attacks
Personal attacks include content intended to harm or anger other members. This also covers attacks against groups (even if not named directly). Provocation is not an excuse for personal attacks. If interactions become heated or inappropriate, we recommend taking a breath, reporting violations, and stopping further engagement.
Harassment
Harassment includes repeated or sustained efforts to annoy, embarrass, or persecute others, including unwelcome communication after requests to stop, ongoing intimidation, bullying, or real-world personal conflicts. If you are harassed, politely ask for it to stop. If it continues, use the site’s report tools to notify staff.
Trolling
Posting intentionally inflammatory or offensive material to provoke arguments is considered trolling.
Threatening Behavior
Threatening the life, safety, or well-being of others will result in immediate account termination.
Copyright and Other Intellectual Property Protections
ArtAroundLife respects copyright and trademark law and will remove works that infringe on these rights. If you believe your intellectual property is infringed, you can file a formal complaint.
Upload Limits
You may upload up to 30 works per day across all your ArtAroundLife accounts. If multiple accounts exceed this limit, all accounts may be closed.
Bots and Fake Accounts
Using bots, multiple accounts, or scraping tools in ways that interfere with Marketplace functionality or integrity is prohibited.
Account Removal for Policy Violations
Accounts violating content or account policies (including this User Agreement, Community and Content Guidelines, and IP/Personality Rights policies) or used for unintended purposes will be permanently disabled. If an account is linked to an existing banned account, consequences apply to all associated accounts.
Indigenous Cultural and Intellectual Property (ICIP)
ArtAroundLife respects the ICIP rights of Aboriginal and Torres Strait Islander peoples and recognizes the cultural significance of Indigenous art.
Misuse or misappropriation of Indigenous art can cause harm and cultural offense. Artists must accurately label their content when uploading. Non-Indigenous artists should not label, tag, or describe their work as “Aboriginal and Torres Strait Islander art.” Misleading labeling will result in removal. Please refer to our Indigenous Australian and Torres Strait Islander Art Policy for more details.
Tips for Resolving Conflicts with Other Members
At ArtAroundLife, we pride ourselves on fostering a warm, supportive atmosphere for artists. The blend of diverse backgrounds, cultures, and perspectives makes ArtAroundLife a lively and vibrant space to share your creativity. Most people do the right thing and enjoy the fun of being here. The following tips are designed to help us support each other and defuse any minor conflicts that may arise.
Prevention is Better than Cure
- Respect, tolerance, and empathy go a long way—even if you don’t agree with someone’s viewpoint.
- Focus on the people and content you like. It’s easy to click away, join a different group, or remove someone from your following list.
- Treat others as you’d like to be treated (an old saying, but it still holds true).
- If you can’t say something nice, it’s better to say nothing at all (another old saying that holds true!).
Tips for Resolving Online Conflicts
- Before responding, give everyone involved some time to cool off.
- Consider that misunderstandings, language barriers, or misleading humor might be involved.
- Think about how your response might help de-escalate the situation.
- Use positive, “let’s work this out” language, and avoid using “you”—instead, use “I” statements. For example, instead of saying, “Your flag-burning photo offends me,” you might say, “That photo of the burning flag makes me feel very uncomfortable.” This helps avoid triggering defensiveness over what’s already happened.
- Politely ask them to stop contacting you and then ignore their messages. There’s a script at the end of this section that might be helpful.
- The more people who get involved, the longer it usually takes to resolve a situation. “Rallying supporters” often complicates matters further.
- Most people want to do the right thing. Many disagreements can be smoothed over with a few deep breaths and a little diplomacy. If behavior escalates, you can report it using the site’s report links for review.
Currently, ArtAroundLife does not offer a blocking feature.
- Intellectual Property and Publicity Rights
ArtAroundLife is a community built on respect and recognition of artists. We kindly ask that you keep this in mind when publishing work on ArtAroundLife. If you ensure that everything you upload is based on your own original ideas and does not infringe on anyone else’s intellectual property or publicity rights, you help us create a supportive and creative environment. Additionally, passing off someone else’s work as your own not only goes against the spirit of ArtAroundLife—it’s also illegal.
There are many international treaties related to intellectual property, but laws vary from country to country. Generally speaking:
- Copyright law protects the expression of original ideas in tangible forms—like photos, paintings, poems, or stories.
- Trademark law protects words, symbols, or designs that identify the source of goods or services.
- Publicity rights protect an individual’s name, likeness, and persona. In short, this means you cannot exploit someone else’s identity for commercial gain without their consent.
Regarding fair use: If you create something that is considered “fair use” or another form of permitted use, you might be able to incorporate copyrighted or trademarked elements in your work. However, fair use typically applies to limited scenarios and is not the same as “freedom of expression.” Frankly, fair use can be tricky to navigate even for experts, and its scope varies by country. Therefore, even if you believe your work falls under fair use or other permitted uses, you should consult a lawyer before using it on ArtAroundLife. While certain uses may seem “fair” or permitted to you, we hope you understand that ArtAroundLife must act in accordance with its “notice and takedown” process if we receive a report. In some cases, even without a report, content might be removed if we become aware of potential infringement.
Ultimately, you are solely responsible for the works you upload and display on ArtAroundLife. This is reflected in the ArtAroundLife User Agreement. By using the ArtAroundLife site, you continuously agree to this policy.
So please do us all a favor: if someone else has created or owns the copyright, trademark, or publicity rights in an image, drawing, photo, logo, story, poem, or any other work (whether it’s an individual or a multinational corporation), get their permission before using it on ArtAroundLife. This helps ensure you’re not infringing on anyone else’s rights and contributes to making ArtAroundLife an inspiring, meaningful, and aesthetically rich environment full of talent and soul.
Repeat Infringer Policy: If an account is found to be in violation of any of our content or account policies—including the User Agreement, Community & Content Guidelines, or IP/Publicity Rights Policy—or is used for purposes not intended by ArtAroundLife, it may be subject to account-level action under our repeat infringer policy and other policies, up to and including permanent disabling of the account.
Notice and Takedown Procedure – Reporting and Complaints
ArtAroundLife respects the intellectual property rights of others and requires that our users do the same. If you believe your rights have been infringed, please notify ArtAroundLife’s designated complaints agent (by submitting the form below). Your notice must include the following essential information:
- An electronic or physical signature of a person authorized to act on behalf of the owner of the relevant matter.

- A statement under penalty of perjury that:
a. The above information is accurate, and
b. You are authorized to act on behalf of the owner of the rights involved.
Please use the “Notice and Takedown Report” form to submit your complaint. For other IP-related complaints, you may email support@ArtAroundLife.com. In some cases, ArtAroundLife may suspend or terminate users who we believe have willfully infringed the copyrights, trademarks, publicity rights, or other rights of others (see Account Deletion for policy violations).
If Your Work Is Named in a Notice and Takedown Report
If the ArtAroundLife Content Team receives a report specifically referencing one or more of your works, those works will be removed. You will no longer be able to view or update them. The report may also include other artists’ works, but by removing your work, we’re not making a determination on whether it does or does not violate copyright, trademark, or publicity rights laws. We have a legal obligation to act on submitted reports in line with our IP/Publicity Rights Policy.
Although the removed work might not be a direct copy of someone else’s work, it may include elements, symbols, or personal likenesses that infringe on others’ rights. If you believe the report is mistaken or doesn’t apply to your work, you have the right to file a counter notice.
We’re sorry that legally, we can’t provide personal advice about copyright, trademark, or publicity rights, nor can we offer personal opinions on these issues. We encourage you to research the relevant laws and how they apply to your online work (see links below) or consult with an IP expert if you’re unsure why your work was named in a notice and takedown report.

- A description of the material removed and its URL on ArtAroundLife.

- A statement that you consent to the jurisdiction of the federal courts in San Francisco County, California, and will accept service of process from the person who provided the original notice or their agent.
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification.
Please use the Counter Notice form to submit your response. If we receive your counter notice but your work does not comply with the ArtAroundLife User Agreement or IP/Publicity Rights Policy, we may notify you that we’re unable to restore it. We might also ask for additional information to help us determine if the work can be restored.
However, in many cases, we will forward your counter notice (including your personal contact information) to the original complainant. They may choose to file a legal claim against you in the U.S. If they do not file within 14 days, you can contact us to request restoration of your work. If your work complies with our User Agreement and IP/Publicity Rights Policy, we may restore it at that time.
